ReplyDeleteI get Roberts is playing chess (at least Roberts thinks so) and that this decision is very Holmes-like. Yes it is nuanced and has limitations on the commerce clause and certainly on mandates. Yes it may help tip this election to Mitt Romney and may prompt Congress to do some heavy lifting for a change. Still, it is a grave disappointment. He could have gone with the dissent and still written the opinion he did. Rather he wanted to look independent and he is in his heart a Statist.

Of course, I think it is marxism, sure, but it is more than that (and thanks for helping me to pin down a key element).
The parts that churned me: that the Portuguese were forced to BURN their fishing fleet (burn it!) and that the old bastards (cough, cough, Boomers) are the ones living reasonably well while their grandchildren scrape and suffer -- I certainly don't believe in spoiling children, but this is horrible; this isn't the way we're supposed to treat our kids (nor is Lionel's song, which I always thought sounded limp d*cked by the way, expressing how you're supposed to treat your spouse/partner/lover/romantic attachment).
