In my mind from what I see, it is clear murder. There really is no way to draw any conclusion. He's not a threat to the officer since he's running away from him and facing away from him. He isn't holding anything that could be construed as a threat to the officer and then the officer walks up to him and drops something next to him. What that is, I don't know. Everything points to 2nd degree murder. Period.
