  1. This is written as though the prosecutors did some glorious thing in fessing up and permitting the case to go back down. Problem is, the poor sucker of a defendant has to go through a trial again, at his or the public's expense, and to his personal detriment. The remedy for misconduct should be directed acquittal.

    The power of prosecutors is abused regularly in crimes great and small. It's a regular occurrence in the so called white collar crimes. The main difference is in the resources of the defendants. Very few can afford defense at all, and for most it's financially ruinous or impossible.

    This will only stop when the remedy becomes dismissal of the prosecution not a retrial. And when prosecutors are disbarred or at least admonished for their conduct.

    Don't hold your breath.
